2 HELP FUND AFFORDABLE HOUSING IN BERKELEY

On Tuesday, July 12 (7pm at 2134 MLK Jr. Way), the Berkeley City Council will vote to increase the amount of money that developers are required to contribute to affordable housing  projects like the BSC.  Unfortunately however, there is a loophole in the law that would allow developers to avoid paying a significant amount of the fee.  To help close the loophole and fund more affordable housing in Berkeley, send an email to both This email address is being protected from spambots. Subject: Fix The Mitigation Fee Loophole: Require Developers to Pay the Full Mitigation Fee (Amend Item 31)

Dear Berkeley City Councilmembers,

I am writing to you about item 31 (Revisions to the Affordable Housing Mitigation Fee), specifically to ask you to close a loophole in the item that would reduce our ability to fund affordable housing.  Although I support raising both the mitigation fee and  the number of below-market-rate units accepted in-lieu of the fee (both of which have always been too low), I strongly oppose discounting the fee for projects which pay the fee early.  Although well-intentioned, this discount will only serve to reduce the money available for affordable housing.

Developers are jumping at the opportunity to build in Berkeley due to the high rents that can be extracted, making a discount for early payment not only unnecessary but in fact harmful.  Near-every developer will choose the discount, making the real fee artificially low and denying the housing trust fund of desperately needed funds. Please close the loophole by eliminating the mitigation fee discount.
